Terms of Service

These terms govern your use of Form to CMS — the Framer plugin, the dashboard at app.formtocms.com, the hosted forms, and the APIs behind them (together, "the service"). By creating an account or installing the plugin you agree to them. They're written to be read; if anything is unclear, ask.

1.Who we are

The service is operated by Henry Kirkness, a sole trader trading as Studio Henry, based in England, United Kingdom. Contact: henry@kirkness.com.

2.What the service does

Form to CMS collects submissions from visitors to your website, screens them, holds them for your moderation, and publishes the entries you approve to your Framer CMS. It includes optional paid listings (processed through your own Stripe account), listing expiry, and an audit trail.

3.Accounts and workspaces

  • You sign in with an email magic link; keep access to that inbox secure — anyone who controls it controls your account.
  • Workspaces (organizations) are shared: everyone you invite can see and moderate the workspace's submissions. Invite people you trust with that.
  • You must be at least 18, or the age of majority where you live, to hold an account.

4.Your sites, your submitters, your responsibilities

You operate the sites that use the service. That comes with obligations we can't take on for you:

  • You must have the right to run the forms you run and to publish the content you approve.
  • You are the data controller for your submitters' personal data (names, emails, submission content); we process it on your instructions. Make sure your own privacy notice covers submissions.
  • You're responsible for what you approve. Moderation tools help you decide; the decision is yours.
  • Don't use the service to collect data from children, or to run forms that collect special-category data (health, politics, religion and similar) — it isn't built for that.

5.Paid listings and money flows

  • Payments for paid or featured listings flow from your submitters to your own Stripe account. We take 0% of listing revenue.
  • Rejecting a paid submission triggers a full automatic refund to the submitter. Beyond that, refund policy for your listings is between you and your submitters.
  • We are not a party to the transaction between you and your submitters, and we don't hold your funds at any point.

6.Free trial

New workspaces get a 14-day trial of the Pro plan, no card required, starting when the first site is connected. When it ends the workspace moves to the Free plan automatically — nothing is deleted and published entries stay live, within Free plan limits.

7.Subscriptions and billing

  • Paid plans are billed per workspace, monthly or yearly, through Stripe. Prices are listed on the homepage; taxes may be added at checkout depending on where you are.
  • You can upgrade, downgrade or cancel any time from the billing page. Cancellation takes effect at the end of the paid period; we don't pro-rate partial months.
  • If a renewal payment fails, the service keeps working while Stripe retries. If payment can't be collected, the workspace moves to the Free plan.
  • We'll give at least 30 days' notice by email before any price increase affects you.

8.Fair use and limits

Each plan carries a monthly submission allowance and a site cap, enforced with headroom: your forms only pause once you're 50% over the allowance, and nothing is ever deleted for going over. We may throttle traffic that looks like abuse (automated flooding, denial-of-service patterns) to protect other customers.

9.Acceptable use

Don't use the service to:

  • collect or publish unlawful, defamatory, or infringing content;
  • send spam or run deceptive schemes (including fake listings);
  • probe, overload, or interfere with the service or other customers' data;
  • resell the service itself without our written agreement (building client sites on it is fine — that's what the Agency plan is for).

We may suspend accounts that break these rules, with notice where practical.

10.Your content and our IP

  • You (and your submitters, per your terms with them) own your content. You grant us the licence needed to store, process, screen and publish it — that's the service working as intended, nothing more.
  • We own the service: the software, plugin, design and documentation. You get a non-exclusive right to use them while you have an account.
  • Feedback you send us can be used to improve the product without obligation.

11.Availability and support

The service is provided "as is", without a formal SLA. We work to keep it fast and available, we back up data continuously, and we publish honest status information when things break. Support is by email; paid plans get priority.

12.Ending things, and your data

  • You can delete your account and workspace at any time; that deletes your data (see the Privacy Policy for timelines and backup residue).
  • We can terminate accounts that materially breach these terms. Where the breach is fixable we'll ask you to fix it first.
  • If we ever discontinue the service, we'll give at least 60 days' notice and a way to export your data.

13.Liability

To the extent the law allows: we're not liable for indirect or consequential losses (lost profits, lost data caused by your own configuration, and similar), and our total liability for all claims in any 12-month period is capped at the greater of the fees you paid us in that period or £100. Nothing in these terms limits liability that can't be limited by law (like fraud, or death or personal injury caused by negligence). If you use the service as a consumer, your statutory rights are unaffected.

14.Changes to these terms

We may update these terms as the product evolves. For material changes we'll email account holders at least 14 days before they take effect. Continuing to use the service after that means you accept the new terms.

15.Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction — except that if you use the service as a consumer, you keep any mandatory protections and forum rights of the country you live in.
